Court of Appeal: A New Victory for Woods and Its Client in an Application for Authorization to Institute a Class Action
Woods is proud of this new victory in the Court of Appeal in favour of its client Vidéotron G.P. and other multinational telecommunications and digital companies involved in a class action lawsuit in which the plaintiff contested the absence of notification after the end of a promotional period resulting in billing at regular price, as terms of the promotional offer were agreed at the signature of the contract.
The Honourable Guy Gagnon, Patrick Healy and Michel Beaupré dismissed the appeal in the Benabu v. Bell Canada & al (500-09-027644-186) case on November 15, 2019. They confirmed the decision handed down by the Honourable Stéphane Sansfaçon, J.S.C. by upholding the main argument presented by our firm that the Defendants’ practices do not contravene section 230 c), which seeks to prohibit practices of a completely different nature from those engaged in by the Defendants.
